Terms and Conditions

Please read these Terms carefully and make sure that you understand them, before making any payment to our Foundation. 

You should print a copy of these Terms [or save them to your computer] for future reference.

Article 1 Definitions
1.1 The WellBeeing Foundation is the user of this general terms and conditions and contractor. 
1.2 When talking about Customer, this refers to: other party, client, purchaser, participant or extra participant of the services of the WellBeeing Foundation.

Article 2 Our Products & Services
2.1 The training provided by the Wellbeeing Foundation is carried out in accordance with a pre-established programme which, according to the objectives set, specifies the teaching, technical and supervisory resources implemented as well as the processes for monitoring its execution and assessing the results.
2.2 Participation in the training provided by the Wellbeeing Foundation implies that the buyer of the said services, hereinafter referred to as “the Customer”, that the latter ensures that the registered participants have the required knowledge and / or meet it in terms of competence to be able to follow the training.
2.3 Additional services including but not limited to consulting, support and maintenance of bee hives, will follow terms drafted and agreed upon by the Wellbeeing Foundation and the Customer.

Article 3 Booking
3.1 Introduction Course
Theoretical courses can be booked via the booking form available on our website. On submission of the theoretical course the Wellbeing Foundation will accept your offer by entering your booking onto the system and sending you an email confirming that you have been booked together with information in order to complete your payment and save your spot in the course. 
3.2 Practical Training
Practical bee-keeping training can be booked via the booking form available on our website. Same terms apply as the Introduction course. In addition, for enrolling and participating in the Practical training, it is required that you have taken the Buzzing Bees: Introduction Course or have some experience as a conventional beekeeper to participate.

Article 4 Payments
4.1 Training fees can be paid at the point of booking via iDeal’s secure online payment process. Otherwise they can be paid later by Bunq. An email will be sent to you confirming payment. 
4.2 Please note that if you do not provide accurate details (including type of card and number) or if your credit card company does not authorise payment, your application will be deemed void. The Wellbeeing Foundation will not accept any liability for costs incurred as a result of applications deemed void in this manner.
4.3 Sales taxes (VAT, TVA etc.), if any, are charged at the applicable rate depending on the product and/or customer.
4.4 The fee is calculated on the basis of the applicable period rate of the selected program, service or product of the WellBeeing Foundation or another, by its rate confirmed in writing. Factors like importance of the assignment, specialist nature of the assignment, capacity of the Customer and urgency of the execution activities can lead to rate adjustment.
4.5 Payment in installments is only possible when indicated by the WellBeeing Foundation

Article 5 Changes to courses
5.1 Wellbeeing Foundation reserves the right to make a change in the contents, relocate the site of the Courses and change the instructor(s). They may further develop or update the content of the Courses without prior announcement.
5.2 Wellbeeing Foundation reserves the right to cancel a Course or re-schedule a Course Date at any time and for any reasons. Wellbeeing Foundation shall endeavor to inform Customer as soon as possible of the cancellation or rescheduling, and in case of rescheduling, to offer a new Course Date. 

Article 6 Cancellation
6.1 The Customer may and is therefore entitled to cancel participation in the training and thereby terminate the agreement. Cancellation and termination is only possible by means of written notification via letter or email and is only valid when it has been received and confirmed by the WellBeeing Foundation. 
6.2 In the event of cancellation, the WellBeeing Foundation is obliged to the following:

  1. Earlier than 6 weeks cancellation, full refund will be provided 
  2. Within 3-6 weeks cancellation, 75% of the original fee will be refunded. 
  3. Within 3-1 weeks cancellation, 50% of the original fee will be refunded 
  4. Within a week cancellation, 30% of the original price will be refunded. 

6.3 When the WellBeeing Foundation is unable to attend, they inform the Customer of this as soon as possible. The booking  will be rescheduled at another time. If rescheduling is not possible, WellBeeing refunds the invoice amount.
6.4 For the Practical Training courses the Wellbeeing Foundation withholds the right to cancel a Customer’s participation. In this case, the Customer will receive a full refund. 

Article 7 Donations
7.1 Any donation made to the Foundation can be revoked within 2 weeks of completion of payment. The full refund will be sent to the account from which the original donation was made upon receiving a written request via email info[at]wellbeeing.org
7.2 The Wellbeeing Foundation reserves the right to use your donation at our discretion but within our stated efforts to support the bees.
7.3 These Donation Payment Terms and Conditions are governed by Dutch law and are subject to the exclusive jurisdiction of the Dutch courts.

Article 8 Customer Obligations
8.1 The Customer must ensure that WellBeeing Foundation has received the correct and complete information requested and is required for the training. This also applies to information about an extra participant for training. 
8.2 During the training the Customer should approach the course from a positive perspective and be cooperative.

Article 9 Rights of the WellBeeing Foundation
9.1 We may revise these Terms from time to time in the following circumstances: 
(a) changes in how we accept payment from you; 
(b) changes in relevant laws and regulatory requirements. 
9.2 Every time you order Services from us, the Terms in force at that time will apply to the Contract between you and us. 
9.3 Whenever we revise these Terms, we will keep you informed and give you notice of this by stating that these Terms have been amended and the relevant date at the top of this page.

Article 10  Intellectual property rights
10.1 The intellectual property rights of the training courses developed by the WellBeeing Foundation,programs, documents, brochures, handouts, lectures, exercises, offers, expressions on its website or social media channels, ezines, emails, models, techniques, other records and information arising from the activities and software that WellBeeing used are owned by it or its licensor, unless another copyright holder is in a work indicated.
10.2 Without prior written notice permission from the WellBeeing Foundation it is not permitted to make any provision to the Customer delivered concept, material or information whole or in part to edit, reproduce or to make public, through any medium, to make it available to third parties, or to to make available to third parties, whether or not against a compensation.

Article 11 Liability
11.1 The WellBeeing Foundation does its best insight and ability in the implementation of her work on all assignment agreements. The ultimate result of this also depends on factors over which the WellBeeing Foundation has no influence to practice. The WellBeeing Foundation can therefore not guarantee the result of the work performed by it.
11.2 With regard to the delivery of products the possible liability of the WellBeeing Foundation limited to the possible delivery of a replacement product or refund of the amount paid by the Customer in case of a defective delivery.
11.3 The WellBeeing Foundation is not liable towards Customer for any damage resulting from any default in its performance obligations towards the Customer or damage resulting directly or indirectly from the performance of the agreement, unless and insofar as this damage is due to intent or deliberate recklessness of the WellBeeing Foundation.
11.4 The WellBeeing Foundation is not liable for damage resulting from errors or omissions of third parties or auxiliary persons charged by it with the performance of the work.
11.5 The WellBeeing Foundation is not liable for damage resulting from a shortcoming of Customer (or additional participant) or third parties.

Article 12 Force majeure
Neither party shall be liable to the other for any delay or failure to perform any obligation under these Terms & Conditions (except for a failure to pay fees) if the delay or failure is due to unforeseen events which are beyond the reasonable control of such party, such as a strike, blockade, war, act of terrorism, riot, natural disaster, failure or diminishment of power or telecommunications or data networks or services, or refusal of a license by a government agency each a Force Majeure Event


Article 13 Confidentiality confidential information
13.1 All information that will be obtained during a program, service or other product will be kept in complete confidentiality.
In addition, no substantive information provided will be made public in the context of the implementation of the agreement received from the Customer, unless otherwise agreed upon.
13.2 Information is considered confidential if it is passed on The WellBeeing Foundation or other participants communicated or if this arises from the nature of the information. When in doubt, the information is like designated confidential.
